Mark Dunn Photography Ltd is a professional photographer based in Derby, specialising in high-action sports photography, live performance, and corporate events. With a reputation for capturing the "split-second" moments that define an event, we provide high-quality visual assets for national publications, commercial clients, and private commissions.

4.  Integrity of the Image:  While we utilize professional post-production techniques to enhance the quality of our work, we are committed to representing scenes honestly. In our sports and news work, we do not digitally alter the reality of an event, ensuring the "truth" of the moment remains intact.

5.  Copyright and Intellectual Property:  We strictly uphold UK Copyright Law. Unless otherwise agreed in writing, Mark Dunn Photography Ltd remains the primary owner of the intellectual property of all images produced. We provide clear, transparent licensing agreements to our clients, ensuring they have the rights they need to succeed.

6.  Professionalism and Safety​:  We maintain comprehensive Public Liability and Professional Indemnity insurance. We are committed to a safe working environment, conducting risk assessments for all large-scale event shoots to ensure the safety of the public, the crew, and the athletes or performers involved.

7.  Accountability:  As a professional member of the photography community, we strive to meet the standards set by leading UK professional bodies. Any disputes are handled with transparency and a commitment to fair resolution.

9.  Definitions:​

a. "The Photographer": Mark Dunn Photography Ltd.

b. "The Client": The person, organisation, or entity booking the services.

c• "The Images": All visual representations furnished by the Photographer, whether prints, digital files, or other data.

10.  Booking and Deposits:  

a.  A booking is considered "confirmed" only upon receipt of a 20% non-refundable deposit and a signed booking form.

b.  The remaining balance is due 14 days prior to the event date or upon delivery of the images, as specified in the invoice.

11.  Copyright and Ownership:  Statutory Copyright: In accordance with the Copyright, Designs and Patents Act 1988, the copyright of all images remains the sole property of Mark Dunn Photography Ltd at all times.

12.  Moral Rights: The Photographer asserts their moral right to be identified as the author of the work.

13.  Usage Licence:  Upon full payment, the Photographer grants the Client a non-exclusive, non-transferable licence to use the images for the purposes specified in the initial agreement (e.g., social media, editorial, or personal use).

13.  Restrictions:  Images may not be sold to third parties, sub-licensed, or entered into competitions without express written permission from Mark Dunn Photography Ltd.

14.  Social Media:  Images shared online must credit "Mark Dunn Photography" where possible.

15.  Artistic Style and Output:  The Photographer will provide a high-quality selection of edited images. The Client acknowledges that the Photographer’s "style" is a matter of artistic judgment and may not be contested.

16.  Raw Files: We do not provide unedited (RAW) files under any circumstances.

17. Cancellations and Postponements: 

a.  Cancellations made within 48 hours of the event may be subject to a cancellation fee of 50% of the total booking value.

b.  If the Photographer is unable to attend due to illness or unforeseen circumstances, our liability is limited to a full refund of all monies paid.

18.  Liability and Insurance

a.  Mark Dunn Photography Ltd maintains full Public Liability and Professional Indemnity insurance.

b.  The Photographer is not responsible for compromised coverage due to venue restrictions, poor lighting conditions, or interference from third parties.

19.  Data Protection (GDPR):  Client data is stored securely and used only for the purpose of fulfilling the contract. We do not sell data to third parties. For more information, please see our Privacy Policy.

20.  Licence Agreement:  Mark Dunn Photography Ltd "leases" the images to Sports News UK - an online news page which is still being developed.
